Terms & Conditions

General Agreement
Agreement, material specification and payment schedule is an integral part of this Allotment letter. On acceptance of this allotment letter, please return the duplicate of the same with your signature for our records. The Management of Epic congratulates you on this occasion and look forward for successful handing over of your apartment.

 General Terms & Conditions of Allotments
1. Payments of Down Payment, Installments, Car Park costs, additional work& other charges payable shall be made by Cheque / pay – Order/ DD in favor of Epic Properties Ltd, which receipt will be issued by the proper authority. (Chairman or MD).

2. Payment of installment and other charges are to be made on due dates. The company may issue reminders to the Allottee but not withstanding the issue of reminders, the Allottee must adhere to the schedule of payment to ensure in time completion of Construction.

3.In case of default in payment of the installment amount within the due date as per the agreed payment schedule, 2% interest per month shall be charged on the unsettled installment amount.

4. If the payment of due installment is delayed beyond 60 days, the company shall have the right to cancel the allotments without serving any notice to the Allottee. In such event, the amount paid by the Allottee will be refunded after deducting 10% of total agreed price of apartment along with car park (s) as penalty after allotting the Apartment to a new Allottee and realizing at least the equivalent amount from new Allottee against the amount paid by the defaulted Allottee. If the Allottee decides to surrender the Allotment the same penalty shall apply and the refund process shall also be the same.

5. Connection fees/charges, Security Deposits and other incidental expenses relating to Electricity/ Gas/ Water & Sewerage / Deep Tube well Connection are not included in the price of the apartments. These payments will be made by Epic directly to the concerned authorities on the Allottees account. The Allottee will have to pay Tk. 80,000/= against utilities connection cost of each apartment before handover of the apartment.

6. Limited change in the Apartments & other facilities may be made by the Epic for greater and overall interest of the project.

If the Allottee intends to have, any modification of the civil or electrical work of his/her apartment compared to the standard set by Epic management. Implementation of any such modification work, whether in part or full, is strictly subject to prior approval of Epic management. In the event additional cost is involved in implementing any such modification request, the concerned Allottee must bear such cost. The Allottee is at liberty to select fittings & fixtures of his/her own choice other than those specified in the Epic’s standard material specification sheet. However, if additional cost is involved for use of any such fittings and/or fixtures, the Allottee must bear such extra cost.

7. Civil layout, electric layout, modification, finishing material confirmation should be completed within 30 days after dispatched of request letter for the mentioned purpose, if it doesn’t civil layout, electric layout will be made as per Epic standard. However, no modification will be done after official handover of the project. If there is any, it has to be done by apartment owner with his owner with his own cost and arrangement.

8. The possession of each apartment shall duly be handed over to the Allottee on completion and on full payment of installments and other charges and dues. Until than the possession will be held by the Epic.

9. Upon registration, the apartment owner, irrespective of the floor, will become the proportionate owner of the undivided and undemarcated land on which the building is constructed.

10. After having possession of the Apartment the Allottee must consult with the Epic prior to undertake any structural or lay out change within the apartment complex. Failure to do so will be at the sole risk of Allottee.

11. The completion period may be effected and delayed by the unavoidable circumstances beyond the control of the company, like Force Majure, Natural calamities, political disturbances, Act of God, Strike, unavailability of material, change in the Fiscal policy of the govt.etc. If Apartment is not handover in schedule time then the Epic will pay monthly rent.

12. After handing over the apartment to the Allottee, Epic provides 6(six) months warranty for any defect in main Electrical, Sanitary, Gas and other utility connection lines. However, this warranty does not cover any defect caused due to customer’s negligence or mishandling.

13. After the expiry of warranty period, any additional cost will be incurred for any kind of repairing or modification of apartment, the owner will bear any of such expenses.

14. Epic will not take any responsibility to provide finishing materials beyond Epic standard. Epic will refund the amount only as per Epic standard to the allottee if there is any.

15. If for any reason beyond the control of Epic the implementation of “Epic Kiran is abandoned, Epic will refund to the Allottee the Down payment and all installments deposited within 1(one) year from the announcement made to this effect.

16. After handing over the apartment to the Allottee by the Epic a cooperative society will be formed. All the apartment owners will be the members of the society by contributing the reserve fund.

17. The buyer must be a member of the Owner’s welfare society, which will formed by the Owners of the apartments with the view to maintaining the general affair of the complex for common interest. Each apartment owner must initially deposit Tk. 30000/= to the reserve fund before taking possession of Apartment.

18. No modification will be allowed that effects on elevation of the complex, sanitary line etc.
